Robert F. Vargo authored an article for the South Texas Law Journal titled "Equity Participation by the Institutional Lender – The Security Status Issue." The article, published in Volume 26, Pages 225-241, examines and analyzes the various approaches utilized by the courts in resolving the question of whether a particular type of note, the equity participation financing arrangement, should be considered as a security or as an investment.
